Dench v. Hennell. Bill and Answer

Plaintiffs : Esther Dench and others
Defendants : Hannah Killingley, Robert Hennell and John Augustus Fulk
Amended 12 Sept 1809 : Robert Hare Killingley added as a defendant

Research Note :- Hannah Killingley, Robert Kennell and John Augustus Fulk were the Executors of the Will of Robert Harris Cooper

Bill Details :-
Esther Dench residing at Lancaster Court, Strand
Elizabeth Romer née Cooper had reached 21 years in January 1807
Mary Cooper had reached 21 in Ferbruary 1807
Sarah Cooper residing with mother
John Cooper residing at Bouverie Court
Ann Cooper, age 17, residing at Tavistock Square Covent Garden

When Elizabeth had reached 21 John Romer asked the Executors and Trustees for a full account of their share of the estate of Robert Harris Cooper This was received in writing which showed the total to be only GBP 186.. He accepted this as money was needed. The Executors and Trustees also promised to surrender to Elizabeth Romer, née Cooper, her share of the copyhold property but this had not happened.

The Trustees and Executors had, since the death of Robert Harris Cooper, continued to receive all the rents and profits and had advanced small amounts of money to Esther Dench. The had refused to come to a settlement and had claimed that the estate was actually of little more value than that required to cover Robert Harris Cooper's debts. Part of the estate had been shares in a lead mine.
